1. Introduction and Acceptance of Terms

Welcome to LiveInVibe. These Terms of Use ("Terms") constitute a legally binding agreement between you and LiveInVibe ("we," "us," or "our") governing your access to and use of the LiveInVibe website ("Service").

By accessing, browsing, or using our Service in any manner, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree with any part of these Terms, you must not access or use our Service.

2. Service Description

LiveInVibe is a platform where users can discover, watch, and engage with a diverse range of live streams broadcast by creators. As of the Effective Date, live broadcasting ("going live") is not available through LiveInVibe; the Service currently provides viewing access to live streams only. This functionality may be expanded to allow LiveInVibe users to broadcast directly in the future.

Users may discover and engage with a wide range of content and interact with creators through features available within the platform, including virtual currency support and social interaction features.

3. User Eligibility and Account Registration

3.1 Age Requirements

You must be at least 18 years of age to create an account and use our Service. By using our Service, you represent and warrant that you meet this age requirement.

Mandatory Age Verification. To ensure platform safety, protect minors, and comply with applicable legal requirements across our operating jurisdictions, all users must complete an Age Verification process before using the Services and interacting with other users.

3.1.1 Verification Procedure and Consent

The standard Age Verification route is carried out through an automated process provided by our third-party partner, Yoti.

  • Process: During this process, Yoti will capture a video selfie through your device's camera. This selfie is analyzed using facial estimation technology to generate facial geometry data (biometric information), which is used solely for age assessment and liveness detection.
  • Explicit Consent: Before initiating the process, the User must provide Explicit Consent. By granting consent, you confirm that you have read and agreed to our Privacy Policy and Yoti’s Privacy Notice , and fully understand how your data will be processed.
  • Data Security: As detailed in our Privacy Policy, Yoti immediately deletes the original selfie image and all collected biometric data after the age estimate is provided. We only receive the final "Successful" or "Unsuccessful" status.
  • Failed Attempts: The Company may provide the User with the opportunity to repeat the Age Verification attempt several times. If the result remains "Unsuccessful" after these attempts, we reserve the right to immediately terminate (ban) your account and prevent further access to the Service.
3.1.2 Right to Appeal and Manual Verification

In the event of a failed automated biometric verification, Users maintain the Right to Appeal the decision. This alternative route involves manual verification by our Support team:

  1. Submission: To appeal, the User must contact Support and submit a valid identity document (ID).
  2. Review and Deletion: A Support Agent will review the ID solely for age verification purposes. The submitted document is permanently deleted on the same day it is received, and in all cases, within 24 hours.
  3. Data Retention: We do not store the uploaded document or any copies thereof. Only the final verification status is retained for necessary record-keeping and security purposes.
3.2 Account Creation Requirements

To create an account, you must provide your full name, a valid email address, a secure password, gender information, date of birth, and agreement to these Terms and our Privacy Policy.

3.3 Account Accuracy and Security

You agree to provide accurate, current, and complete information during registration and maintain the security and confidentiality of your account credentials. You accept full responsibility for all activities that occur under your account and must notify us immediately of any unauthorized use.

3.4 Account Restrictions

You may not create an account if you have been previously suspended or banned from our Service, are using automated tools or bots to create accounts, are creating multiple accounts for the same individual, or are misrepresenting your identity or providing false information.

4. Acceptable Use and User Conduct

4.1 General Conduct Standards

You agree to use our Service in compliance with all applicable laws and regulations and in accordance with these Terms. You shall not use our Service for any unlawful purpose or in any way that could damage, disable, overburden, or impair our Service.

4.2 Prohibited Activities

You explicitly agree not to share your account credentials with others, attempt to gain unauthorized access to other user accounts or our systems, use automated tools or scripts to access our Service, upload or transmit illegal or objectionable content, impersonate any person or entity, transmit unsolicited advertising or spam, interfere with or disrupt the Service, or attempt to reverse engineer any software comprising the Service.

4.3. Content Moderation

We apply content moderation measures to ensure our Service remains safe and compliant with applicable laws and these Terms. Our moderation may include automated tools and human review. We strive to act in a transparent, non-arbitrary, and proportionate manner when enforcing our policies.

If we remove your content or restrict your account, we will endeavor to notify you where reasonably practicable. You have the right to appeal such decisions by contacting us at [email protected]. We will review your appeal and respond in a timely manner.

5. Virtual Currency and Payment System

5.1 Virtual Currency Overview

Our Service includes a virtual currency system (“Tokens”) that allows users to support Creators and access premium content within the platform.

5.2 Purchase Terms and Conditions

All virtual currency purchases are final and non-refundable unless required by applicable law. Virtual currency has no cash value and cannot be exchanged for real currency or transferred to other users or accounts. Account balances are tied to your specific account and cannot be transferred upon account closure.

5.3 Payment Security

Our payment system features PCI DSS compliance for all payment processing, tokenization of payment card data through certified processors, secure transmission of all payment information, and no storage of sensitive payment information on our servers.

6. User Content and Intellectual Property

6.1 User-Generated Content

As of the Effective Date, live broadcasting is not available through LiveInVibe. The following applies to Content you may currently post (such as comments, messages, and profile information), and will apply to live streams and other broadcast content as and when broadcasting functionality becomes available on LiveInVibe: You may upload, post, or share Content through our Service. You retain ownership of your intellectual property rights in such Content.

Content from Third-Party Sources. Separately, live streams and related content displayed on LiveInVibe may be sourced from affiliated platforms or services operated by the Company or its affiliates. LiveInVibe reserves the right to remove or restrict access to any such content on LiveInVibe independently of any actions taken on the originating platform.

6.2 Prohibited Content

You shall not create, upload, transmit, distribute, store, or otherwise make available any content that is prohibited under these Terms through the Service. Prohibited content includes, without limitation:

  1. Illegal or unlawful content, including any content that violates applicable local, state, federal, or international laws or regulations;
  2. Sexual content involving minors, including any depiction, reference, solicitation, or suggestion of sexual activity involving individuals under the age of 18 (zero tolerance);
  3. Non-consensual sexual content, including:
    • content involving coercion, exploitation, manipulation, or lack of freely given consent;
    • intimate images, videos, or recordings shared without the explicit consent of all depicted parties;
  4. Violence, exploitation, or harm, including:
    • graphic violence, cruelty, or abuse;
    • content promoting or glorifying terrorism, extremism, or self-harm;
    • content facilitating or endorsing prostitution, escorting, human trafficking, or sex trafficking;
  5. Hate speech and discriminatory content, including content that incites hatred, discrimination, or violence against individuals or groups based on protected characteristics;
  6. Deceptive, misleading, or fraudulent content, including:
    • scams, phishing attempts, or false promises;
    • misleading representations regarding user identity, services, pricing, or outcomes;
  7. Intellectual property infringement, including content that infringes or violates any patent, trademark, copyright, trade secret, or other proprietary rights of any third party, including pirated software or media;
  8. Instructional or facilitative content for illegal activities, including guidance or instructions related to:
    • manufacturing, purchasing, or using illegal weapons or drugs;
    • hacking, bypassing security measures, or invading privacy;
  9. Malicious or harmful technical content, including software viruses, malware, spyware, or any code designed to disrupt, damage, or extract data from the Service or users’ devices;
  10. Unauthorized commercial content, including:
    • advertisements, promotions, solicitations, or spam in public or private communications;
    • contests, sweepstakes, pyramid schemes, or other commercial activities not expressly authorized by us;
  11. Privacy-violating content, including disclosure of personal or sensitive data of third parties without lawful basis or consent (e.g., addresses, phone numbers, email addresses, or financial information);
  12. Explicit adult content;
  13. Any content which, in the sole discretion of us, is objectionable, restricts or inhibits other users from using the Service, or may expose us, its affiliates, or users to harm, liability, or regulatory risk.
  14. Content that promotes, advertises, or redirects users to third-party services, websites, applications, or competing platforms, unless expressly authorized by us.
6.3 Prohibited Conduct

You shall not engage in any conduct that violates these Terms, applicable laws, or the rights of others. Prohibited conduct includes, without limitation:

  1. Illegal or unlawful activities, including but not limited to:
    • fraud, deception, or misrepresentation;
    • financial scams, money laundering, or pyramid schemes;
    • solicitation, promotion, or facilitation of illegal goods or services.
  2. Harassment and abuse, including:
    • threats, intimidation, stalking, coercion, or extortion;
    • hate speech or conduct targeting individuals or groups based on race, ethnicity, nationality, religion, gender, sexual orientation, disability, or other protected characteristics;
    • bullying or persistent unwanted contact.
  3. Exploitation and harm, including:
    • sexual exploitation, abuse, or grooming;
    • any interaction involving minors or content that depicts or suggests minors in a sexualized manner;
    • promotion or glorification of violence or self-harm.
  4. Service misuse, including:
    • unsolicited commercial communications;
    • use of automated systems or tools without authorization;
    • attempts to circumvent moderation, enforcement, or safety mechanisms.
  5. Impersonation and misrepresentation, including:
    • impersonating any other person, user, entity, or public figure;
    • creating misleading profiles or providing false or deceptive identity information;
    • falsely claiming affiliation with us.
  6. Violation of privacy, including:
    • collecting, using, sharing, or disclosing personal data of others without lawful basis or consent;
    • doxxing or publishing private, confidential, or sensitive information.
  7. Sexual solicitation and commercial sexual activity, including:
    • soliciting, offering, or arranging sexual services, escorting, prostitution, or any form of sexual commerce;
    • using the Service to negotiate, facilitate, or promote offline sexual encounters in exchange for money, goods, or other benefits.
6.4 Content License

By posting content on our Service, you grant us a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your content solely for the purpose of operating and improving our Service.

6.5 Content Restrictions

All content must comply with our community standards and legal requirements. Content that violates these Terms may be removed without notice.

6.6 Our Intellectual Property

The Service, including its design, functionality, text, graphics, logos, and software, is owned by LiveInVibe and is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works from our Service without explicit permission.

6.7. Copyright Infringement

If you believe content on the Service infringes your copyright, you may submit a takedown request to [email protected]. We will investigate and, where appropriate, remove infringing content. Repeat infringers may have their accounts terminated.

7. Anti-Slavery and Anti-Trafficking Policy

7.1. Zero-Tolerance Approach

We adopt a zero-tolerance approach to modern slavery, human trafficking, and any form of exploitation. We are committed to conducting its business ethically, transparently, and in compliance with all applicable anti-slavery and anti-trafficking laws and regulations.

7.2. Strict Prohibitions

You may not use the Service to promote, facilitate, engage in, or support any form of slavery, servitude, forced labor, human trafficking, sex trafficking, or exploitation, including but not limited to:

  1. posting, sharing, or distributing content that promotes, normalizes, or glorifies human trafficking or exploitation;
  2. recruiting, soliciting, or coercing individuals for exploitative purposes;
  3. sharing information, instructions, or contacts related to trafficking or exploitation activities;
  4. attempting to arrange meetings or interactions for the purpose of exploitation or abuse.
7.3. Monitoring and Review

We may use moderation tools, automated systems, and human review to identify potential trafficking or exploitation-related activities within the Service.

7.4. Law Enforcement Cooperation

Any suspected cases of human trafficking or exploitation may be reported to competent law enforcement or regulatory authorities. We cooperate fully with such authorities in accordance with applicable law.

7.5. Enforcement Actions

Violation of this policy may result in immediate content removal, suspension or termination of accounts, and reporting to relevant authorities, without prior notice.

8. Prohibition of Child Sexual Abuse and Exploitation (CSAE)

8.1. Zero-Tolerance Approach

We have a strict zero-tolerance policy toward any form of child sexual abuse and exploitation ("CSAE"). The safety and protection of minors is a fundamental priority.

8.2. Prohibited Behavior

You may not use the Service to create, upload, share, transmit, request, or otherwise engage in any CSAE-related content or behavior, including but not limited to:

  1. any content that depicts, promotes, sexualizes, or exploits minors;
  2. soliciting, grooming, or attempting to engage minors in sexual or exploitative interactions;
  3. sharing links, materials, or references related to CSAE;
  4. attempting to arrange meetings or communications involving minors for exploitative purposes.
8.3. Access Restrictions

Where required by law or the nature of the Service, we may implement age-related access restrictions and verification measures to reduce the risk of CSAE-related activities.

8.4. Detection Systems

We may employ technical, procedural, and organizational measures to detect and respond to CSAE-related risks, including moderation systems and reporting mechanisms.

8.5. Mandatory Reporting

Any detected or reported CSAE-related activity may be immediately escalated, documented, and reported to relevant law enforcement or child protection authorities, in accordance with applicable laws.

8.6. Remedial Actions

Upon identification of CSAE-related content or behavior, we may, without prior notice:

  • remove or disable access to the content;
  • suspend or terminate associated accounts;
  • preserve evidence where legally required;
  • cooperate fully with law enforcement investigations.

9. Privacy and Data Protection

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your information and is incorporated into these Terms by reference. We collect and use your information only as described in our Privacy Policy. Our Service utilizes cloud infrastructure distributed globally, and your data may be processed in various countries as part of our service delivery, always in compliance with applicable data protection laws.

10. Service Availability and Modifications

We strive to maintain high availability of our Service but cannot guarantee uninterrupted access. The Service may be temporarily unavailable due to scheduled maintenance and updates, technical difficulties or system failures, or circumstances beyond our reasonable control. We reserve the right to modify, suspend, or discontinue any part of our Service at any time, with or without notice, including adding new features or functionality, removing or modifying existing features, updating user interfaces and user experience elements, or implementing security improvements.

11. Account Termination and Suspension

11.1 Voluntary Account Termination

You may terminate your account at any time by contacting our support team. Upon voluntary termination, your access to the Service will be immediately terminated, your personal data will be deleted in accordance with our Privacy Policy, and any virtual currency balance will be forfeited.

11.2 Involuntary Account Termination

We may terminate or suspend your account immediately, without prior notice, if you violate any provision of these Terms, engage in fraudulent or illegal activities, your account poses a security risk to our Service or other users, or we are required to do so by law or legal process.

11.3 Effect of Termination

Upon termination of your account, all rights granted to you under these Terms will immediately cease, you must discontinue all use of the Service, and provisions of these Terms that by their nature should survive termination will remain in effect.

12. Disclaimers and Limitations of Liability

12.1 Service Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF THE SERVICE, AND WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

12.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LIVEINVIBE, ITS DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, DAMAGES RESULTING FROM UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA, OR DAMAGES RESULTING FROM ANY INTERRUPTION OR CESSATION OF THE SERVICE.

12.3 Liability Cap

Our total liability to you for all claims arising out of or relating to these Terms or the Service shall not exceed the amount you have paid us in the twelve months preceding the claim.

13. Indemnification

You agree to indemnify, defend, and hold harmless LiveInVibe and its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees arising from your use or misuse of the Service, your violation of these Terms, your violation of any rights of a third party, or any content you post or transmit through the Service.

14. Governing Law and Dispute Resolution

These Terms and any disputes arising out of or related to these Terms or the Service shall be governed by and construed in accordance with the laws of the jurisdiction where our company is incorporated, without regard to conflict of law principles. Any disputes arising under these Terms will be resolved through binding arbitration in accordance with the rules of the applicable arbitration association, except where prohibited by law. You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

15. Miscellaneous Provisions

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and LiveInVibe regarding the Service and supersede all prior agreements and understandings. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to be valid and enforceable to the fullest extent permitted by law. Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision. You may not assign or transfer these Terms or your rights hereunder without our prior written consent, while we may assign these Terms without restriction.

We reserve the right to modify these Terms at any time. When we make changes, we will update the "Last updated" date at the top of these Terms, provide notice through our Service or by email for material changes, and allow a reasonable period for you to review changes before they become effective.
